7. Harmonized System Sixth Review Changes

7.1. Advance Rulings for HS Classification

It should be noted that many Customs administrations offer an Advance Ruling service that provides importers with a time bound, often legally binding decision on the HS classification of a specific product before it is imported. Some countries also issue non-binding “information rulings” or “tariff opinions”.

The concept of advance rulings is embedded in major international trade and customs instruments, including the WCO Revised Kyoto Convention and the WTO Trade Facilitation Agreement.

Why Advance Rulings matter to traders

Advance rulings give traders five concrete advantages:

01 Certainty on correct HS code

02 Predictable duty and tax outcomes

03 Reduced clearance delays

04 Fewer disputes with Customs

05 Smoother repeat shipments

Understanding that an advance ruling procedure exists in many jurisdictions is important because customers may:

·    already hold a ruling that must be applied to their shipments

·    ask staff involved in the shipping process for help interpreting a ruling

·    benefit from being advised to obtain one when recurring classification issues arise

Example:

A customer repeatedly ships a specialized electronic sensor. Each shipment runs into the same Customs friction. An advance ruling breaks the cycle.

Problem

Recurring friction

A specialized electronic sensor is shipped repeatedly. Customs questions the HS code on each shipment, causing delays.

→

Action

Obtain a ruling

The customer is advised to apply for an advance ruling that legally confirms the correct HS code for the sensor.

→

Outcome

Smooth clearance

Future shipments clear smoothly because the HS code is legally confirmed in advance.

Key message: Advance rulings are a trade facilitation tool. When used correctly, they reduce friction, improve predictability, and protect manufacturers and exporters from unnecessary disputes.
